Haben Entry/Exit Gate Procedures and Policies The Homes of Riviera Dunes entry and exit gates utilize an unmanned electronic system actuated by a variety of devices. It is important for residents to become familiar with and utilize the system’s features as intended if an effective balance between convenient entry, privacy, security and gate equipment maintenance costs is to be maintained. It is also important that residents instruct their visitors, guests and contractors in the proper use of the system and insist that it be used as intended. Island Residents contact the HOA's management company for information regarding access to the Laguna entry gate.
Gate Designation and Component Location The right entry lane (outer) has been designated as the resident and large vehicle gate. The left entry lane (under the gatehouse arch) has been designated as the visitor gate. The right exit lane (outer) has been designated as the exit gate for all vehicles. The left exit lane (under the gatehouse arch) is not in use. A gate control pedestal is located on the left side of the left entry lane in front of the gatehouse. One pedestrian gate is located on the sidewalk adjacent to the right vehicle entry lane. A second pedestrian gate is located at the end of the brick walkway on the West end of 3rd Street East.
Tailgating and Unauthorized Entry Each vehicle entry gate is equipped with a barrier arm designed to prevent unauthorized entry via “tailgating”. The entry gate barrier arms are designed to allow only one vehicle (single vehicle or vehicle with trailer in tow) at a time to pass. It will not reopen for a second vehicle unless an authorized open signal is received. Tailgating close behind another vehicle carries the risk of striking and damaging the barrier arm. Anyone causing damage to a barrier arm or the gate operation system is liable for actual repair cost plus 20% or a minimum charge of $300.00.
The one active exit gate is equipped with a barrier arm to prevent unauthorized entry through the exit gate. It is not necessary to use a Key Fob Transmitter to open the exit gate. The exit barrier arm will remain up if multiple vehicles are lines up to exit, however vehicle speed must be moderate to allow the arm sufficient time to react to following vehicles. Entering through the exit gate carries a very high risk of damage to the exit gate and barrier arm. Means of Access Key Fob Transmitters: Residents may purchase up to 6 remote key fob transmitters (clickers) per property from the HOA’s management company for $50 each (non-refundable). These transmitters will remotely open the Resident Entry Gate when actuated within 50 feet of the entry gate. For added community security, generic and programmable remote transmitters will not operate the entry gates.
Visitors Envera Gate Kiosk: Visitors will be greeted by the Envera Virtual Guard and will ask their name and who whey are coming to visit. If the resident has placed the visitor name on their visitor list, the guard will open the appropriate gate. If the name is not on your visitor list, the Envera Guard will call the resident for permission to allow you into our community. If the Envera Guard is unable to contact you, the visitor will be turned away and denied access.
Pedestrian Gates: Both pedestrian gates are secured by combination locks. Entering the code xxxx (please contact management company for code) will open either gate.
Key Fob Information: When purchasing Key Fob Transmitters residents should confirm with the HOA’s Management Company that the identification numbers on the subject devices match those programmed into the gate control system.
If a key fob transmitter becomes inoperative the resident should confirm that the transmitter’s battery is not dead. A weak battery may illuminate the red light on the key fob while not having sufficient strength to signal the gate to open. If the battery is good and the red light illuminates but the gate does not open the resident should contact the HOA’s management company to confirm that the devices identification number is still programmed into the gate control system.
Vendors and service providers needing routine unescorted access to the community must contact the HOA’s management company to make application for addition to the community vender list.
Residents, vendors and service providers are responsible to insure that their entry devices (key fob transmitters ) are used as intended by the HOA. The time and date that each device and/or code is used is recorded by the gate control system. Any use deemed to be detrimental to community security, in violation of community rules and restrictions or inconsistent with the purpose for which the device/code was issued may result in the device/code being deactivated without warning.
Riviera Dunes Way Entry/Exit Gate Owners of the Homes of Riviera Dunes on the Island need to register their cars with the Laguna Guard House at the entry gate. Each resident will be provided one transponder per registered vehicle. The transponder will be affixed to the car and will automatically open the gate as you pull in to it. Amenity Center Rules The Amenities Center is available for your use seven days a week excluding those times that the Association Board of Directors or committee members are meeting. The Board asks that you please turn off all TVs, lights and ceiling fans when you are finished using the facility and lock all doors. No children under the age of 16 are permitted without adult supervision.
Pool Rules
No lifeguard will or shall be on duty and all persons using the pool shall do so at their own risk.
POOL HOURS: Dawn to Dusk
Adult “Residents” who reside within Homes of Riviera Dunes, the Hammocks and their guests may use the swimming pool. A parent, guardian, or responsible adult must accompany minors under age 16.
NO RUNNING, NO DIVING OR JUMPING FROM POOL’S EDGE. NO DISTURBING GAMES, BALLS or other tossing devices are permitted. NO LARGE FLOATS. Personal flotation for children and adults is permissible, if the devices do not interfere with other swimmers.
INFANTS OR DIAPER AGE CHILDREN are permitted to be in the pool with swimmy diapers only. ONLY PROPER BATHING ATTIRE ALLOWED, NO “CUT OFFS” are permitted.
NO PERSON WITH SUNTAN OIL or lotion shall be allowed in the pool in order to prevent clogging of the filters. PLEASE SHOWER BEFORE ENTERING POOL.
NO FOOD OR DRINKS are allowed in pool or on the deck per County Health Codes.
NO GLASS OR BREAKABLE CONTAINERS or objects are allowed in the pool or on the deck.
NO TRASH shall be left in the pool area. Put ALL TRASH in the receptacles provided for that purpose.
All slips at the Homes of Riviera Dunes can only be licensed and used by Riviera Dunes Homeowners. Homeowners can transfer slip licenses by completing and submitting the Assignment of Boat Slip License Agreement.
All vessels should be registered with the HOA by completing and submitting the Vessel Registration Form.
Buying or Selling a Home Selling Homeowner Homeowners who are selling a home in the Homes of Riviera Dunes should make certain that their house and property are in compliance with all Deed Restrictions before placing their home on the market. Verification can be obtained from the Management Company. Seller must provide buyer with all Association Documents. You can do so by pointing them to the Download link on this website. Buying Homeowner The buying homeowners become a member of the Homeowners Association when purchasing a home at the Homes of Riviera Dunes. Buyers must familiarize themselves with the Declarations, Rules and Regulations of the Home of Riviera Dunes community and abide by them. Architectural Review Board (ARB) A review and pre-approval from the ARB is required for the following:
Any new construction on a vacant lot
Any alteration or improvement to the exterior of an existing home
Any repair or restoration that will change the appearance of an existing home
Any change to the landscaping of an existing home
Drainage easements exist between all houses in the development. The City of Palmetto Code of Ordinances places limitations on plantings, structures and alterations that may be installed in these easements so as to prevent disruption of intended drainage. The homeowner is responsible to obtain prior ARB approval before making changes in drainage easements. The owner is responsible to see if additional permits or approvals are required from the City of Palmetto. Landscaping and structures installed without the required ARB and/or City of Palmetto approvals may be subject to removal at the homeowner’s expense. Hurricane protection (see section 4.24) The ARB cannot guarantee any method or materials, which will protect any home in the case of a severe storm. However, any addition of Hurricane Shutters or storm protection requires ARB approval. The time duration for leaving Hurricane shutters onis not to exceed 3 daysafter storm danger has passed. Deed Restrictions Parking (section 5.20)
No Vehicle shall be parked in the Community except on a paved driveway, or inside a garage. Street Parking is strictly prohibited.
No truck or vehicles which are used for commercial purposes, other than those present on business, nor any trailers, may be parked in the community unless inside a garage and concealed from view. (Section 5.20) If an owner/renter has a commercial vehicle, it must be garaged (section 5.01).
No trailer, camper, motor home, boat, boat trailer, canoe or motorcycle shall be permitted to remain on a lot unless placed or maintained in a garage. No maintenance or repair on any boat or vehicle (except for normal washing) shall be permitted upon any Lot except within an enclosed garage. No person shall be permitted to remain in any vehicle parked within the community overnight for any purpose. Except for the purpose of arrivals and departures, no person shall be permitted to remain in the Common Areas between the hours of 12:00 midnight and 6:00 a.m. (section 5.20)
Pets Any pets allowed under section 5.5 shall be kept on a leash except when they are within a fenced or otherwise enclosed area. Dogs should only be walked in the common areas and not on other residents’ yards. All pet feces and other debris are to be removed immediately from the streets, yards and common areas by the pet’s owner. No pets are permitted in the Clubhouse or Recreational areas. (Section 5.15)
Appearance of Areas
No clothesline or exterior clothes drying apparatus shall be permitted, nor shall any clothes, towels etc. be permitted to hang over any fence or otherwise exposed area. (Section 5.09)
Privacy walls or fences may not be placed on any lot without first obtaining written approval from the ARB. (Section 4.11)
Driveway and walkway design, location, material and coloring shall be subject to ARB approval. (Section 4.08)
It is recommended that all pools be enclosed. All pools, fencing and caging are subject to ARB approval. Above ground pools are not permitted. (Section 4.12)
For sale and leasing of a residence, the owner may install one professionally made sign. See the attached Sign Policy for specifications or contact the ARB or Management Company for further information. (Section 5.17)
Garage doors shall remain closed when not in use. (Section 5.09)
No detached outbuildings, including sheds, portable structures, dog houses, or tree houses shall be placed or constructed on any Lot at any time. (Section 5.14)
Any fixed games and play structures shall be located at the rear of the Dwelling Unit. Installation of basketball backboards requires ARB approval for a permanent location of the backboard. (Section 5.02)
No outdoor burning of trash or refuse is permitted. (Section 5.09)
No garbage, refuse, trash or rubbish shall be placed outside of a dwelling. Garbage containers may not be placed out for collection sooner than the morning of the scheduled collection and must be removed within 12 hours of collection. (Section 5.21)
Solar devices or other energy devices shall be placed where minimum exposure to the street is provided and approved by the ARB. (Section 4.16)
All lawns must be sodded with St. Augustine grass or other landscape materials approved by ARB. (Section 4.21)
No exterior antennas or satellite dishes are allowed with the exception of a TV dish (24” or less in size) (section 4.23)
Mold and mildew on roofs, house, driveways and sidewalks is a real issue in Florida. We ask that you regularly walk the perimeter of your home to look and remove these growths. The maintenance standard set by the board is for “no mold or mildew” -we appreciate your diligence on this common but tough issue.
No lot shall be used for any purpose other than a single-family private residential purpose. No owner shall make or permit any public or private nuisance, vibration, noise or sound, which would effect the quiet enjoyment of other owners and guests.
Homes of Riviera Dunes Sign Policy (section 5.17) All signage shall be approved by the ARBand no sign or billboard of any kind shall be displayed for public view from any Lot or living unit or elsewhere within Homes of Riviera Dunes except as follows:
One temporary sign not exceeding 12” X 24” in size and of a color and design and at a location approved by the Architectural Review Board (ARB).
Sign Specifications: 12” X 24” Aluminum sign, white background.
Riviera Dunes Insignia shall be in the upper left-hand corner of the sign in Riviera Dunes (RD) orange color.
REAL ESTATE COMPANY NAME must be on the first line with 2” lettering in RD teal color.
INDIVIDUAL REALTOR NAME must be on the second line with 1” lettering in RD teal color.
PHONE NUMBER must be on the third line with 2” lettering in RD teal color.
A 42” stake must be used with T-BAR stand.
All signs must be located within 18” from the front of the home and installed parallel to the street. For empty lots, the sign must be placed next to the water meter parallel to the street.
If a home is to be rented, please contact the ARB for approval prior to placing any sign on the Lot.
If an empty lot should require another style of sign (no trespassing, parking, etc.) please contact the ARB for approval.
